Terms of use

These terms apply to the Gusto Raffinato app, the GR Sala app and the gustoraffinato.com website, provided by RIGHELLO S.r.l., Via Pio X 21, Mestre (VE), Italy, VAT no. 01979970934 (“we”). By using them you accept these terms. How we handle your data is explained in the privacy policy.

1. What Gusto Raffinato is

Gusto Raffinato is a service for restaurants and their guests. With the Gusto Raffinato app you find venues, request a reservation at venues that use Gusto Raffinato and collect stamps on their loyalty cards. With the GR Sala app restaurant staff manage the floor, orders, bills and reservations.

Gusto Raffinato is not the restaurant: it does not prepare or serve anything and is not responsible for the venues' service, products, prices or opening hours. For those, contact the venue.

2. Reservations

A reservation made with the app is a request: it is valid only once the venue confirms it. The venue may also decline it. Until it is confirmed it shows as “pending”. If you can no longer go, cancel it in the app (History / Storico) as soon as you know: the venue sees it right away and frees the table.

3. Loyalty cards

Each venue decides the rules of its card, the stamps needed and the rewards. Stamps are based on what you were served at the table. Stamps and rewards have no cash value, cannot be exchanged for money and cannot be transferred. A venue may change the rules of its card, and the card may end if the venue stops using Gusto Raffinato.

4. No in-app purchases

Nothing is sold in the Gusto Raffinato app: there are no in-app purchases.

5. Your account and fair use

You must be at least 14 years old. You are responsible for what you do with your account and for the information you enter, which must be true. You must not:

• make fake or bulk reservations, or book in someone else's name without their permission;
• try to obtain stamps or rewards you are not entitled to;
• write offensive, unlawful or unrelated content in reservation notes;
• use the service in an automated way, try to get around its protections or access other people's data;
• use the service unlawfully or to harm venues, other users or us.

In case of abuse we may suspend or close the account, letting you know when possible. You can delete your account whenever you want: see Delete your account.

6. Venue content and maps

Venue data comes from OpenStreetMap (© OpenStreetMap contributors, ODbL licence); photos and ratings from Google Places; maps from Apple Maps. This content remains subject to the licences and terms of their owners and may be incomplete or out of date: check opening hours and details with the venue before you go.

7. The GR Sala app (for restaurants)

GR Sala is reserved for restaurants that are Gusto Raffinato customers and is used under the contract with the restaurant, which prevails over these terms where it says something different. The restaurant:

• is responsible for its staff's access: room codes, PINs and linked devices;
• must inform its customers and staff about the processing in the management system, including the camera and room cameras (signs and, for staff, what Article 4 of Italian Law 300/1970, the Workers' Statute, requires);
• checks and confirms what the artificial intelligence suggests before using it.

8. Liability

We do our best to keep the service working well and without interruptions, but we cannot always guarantee it: there may be pauses for maintenance or failures. To the extent permitted by law we are not liable for indirect damage or for what depends on the venues or on third-party services. Nothing in these terms limits the rights the law gives you as a consumer, or our liability for wilful misconduct or gross negligence.

9. Apps downloaded from the App Store

For apps downloaded from the App Store, Apple's standard licence terms also apply (Licensed Application End User License Agreement). If anything in these terms conflicts with them, Apple's terms apply to the use of the app. Apple is not responsible for the apps or their support.

10. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, the courts of the place where you live or are domiciled have jurisdiction over any dispute. For restaurants, the terms of the contract apply.

11. Changes

We may update these terms, for example when the service or the law changes. Important changes are announced in the app or on the website; the date at the top shows which version is in force. If the Italian and English versions differ, the Italian version prevails.
